Refund and Returns Policy

2. Right of Withdrawal (EU Customers)

In accordance with European Union legislation (Directive 2011/83/EU on consumer rights), you have the right to withdraw from your purchase within a period of 14 calendar days without the need for justification. This withdrawal period expires 14 days from the day on which you, or a third party indicated by you (other than the carrier), acquires physical possession of the product.

3. How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must clearly notify us of your decision via:

You may use the following template:

"I hereby notify that I withdraw from my sales contract for the following product: [product], order placed on [date]."

4. Return Conditions

For a return to be accepted:

  • The product must be in the same condition in which it was received.

  • It must be free of damage, use, or alterations.

  • It must be securely packaged for its return.

  • The buyer is responsible for ensuring the product arrives in good condition.

5. Products Excluded from the Right of Withdrawal

According to EU law, the right of withdrawal does not apply to:

  • Custom-made or personalized products.

  • Works of art or unique pieces made under a specific commission.

  • Products that, by their nature, may deteriorate or be easily damaged if not kept correctly.

At Tierra y Fuego Cerámica, many of our pieces are unique, handcrafted, and of limited production; therefore, some may be excluded from the right of return if they have been clearly described as such in the product description.

6. Refunds

Once the product has been received and inspected:

  • We will notify you whether the return has been approved or rejected.

  • If approved, the refund will be processed within a maximum of 14 calendar days.

  • The refund will be issued using the same original payment method.

7. Return Shipping Costs

  • Return shipping costs are the responsibility of the customer, unless the product is defective or there was an error on our part.

  • Initial shipping costs are not refunded unless there is a legal obligation to do so.

8. Damaged or Defective Products

If you receive a damaged product:

  • You must contact us within 48 hours of delivery.

  • Include clear photographs of the damage and the packaging.

  • We will evaluate the case and, if appropriate, offer:

    • A replacement (if possible).

    • A full or partial refund.

    • Or a solution agreed upon with the customer.

9. Undelivered Shipments or Address Errors

We are not responsible for delays or losses caused by:

  • Incorrect or incomplete addresses provided by the customer.

  • Failure to collect the package.

2. Derecho de desistimiento (clientes de la UE)

De acuerdo con la legislación de la Unión Europea (Directiva 2011/83/UE sobre derechos de los consumidores), tienes derecho a desistir de tu compra en un plazo de 14 días naturales sin necesidad de justificar la decisión.

El plazo de desistimiento expira a los 14 días desde el día en que tú o un tercero indicado por ti (distinto del transportista) adquiere la posesión del producto.

3. Cómo ejercer el derecho de desistimiento

Para ejercer tu derecho de desistimiento, debes comunicarnos tu decisión de forma clara a:

Puedes usar el siguiente texto:

“Por la presente comunico que desisto de mi contrato de venta del siguiente producto: [producto], pedido realizado el [fecha].”

4. Condiciones de devolución

Para que la devolución sea aceptada:

  • El producto debe estar en las mismas condiciones en que fue recibido

  • Sin daños, uso o alteraciones

  • Embalado de forma segura para su retorno

El comprador es responsable de que el producto llegue en buen estado.

5. Productos excluidos del derecho de desistimiento

De acuerdo con la ley de la UE, el derecho de desistimiento no se aplica a:

  • Productos hechos a medida o personalizados

  • Obras de arte o piezas únicas realizadas bajo encargo específico

  • Productos que, por su naturaleza, puedan deteriorarse o dañarse con facilidad si no se conservan correctamente

En el caso de Tierra y Fuego Cerámica, muchas de nuestras piezas son únicas, artesanales y de producción limitada, por lo que algunas pueden estar excluidas del derecho de devolución si han sido claramente descritas como tales en la ficha del producto.

6. Reembolsos

Una vez recibido e inspeccionado el producto:

  • Te notificaremos si la devolución ha sido aprobada o rechazada

  • Si es aprobada, el reembolso se realizará en un plazo máximo de 14 días naturales

  • El reembolso se efectuará utilizando el mismo método de pago original

7. Gastos de devolución

  • Los gastos de envío de la devolución corren a cargo del cliente, salvo que el producto esté defectuoso o haya un error por nuestra parte

  • No se reembolsan los gastos de envío iniciales salvo obligación legal

8. Productos dañados o defectuosos

Si recibes un producto dañado:

  • Debes contactarnos en un plazo de 48 horas desde la entrega

  • Incluye fotografías claras del daño y del embalaje

Evaluaremos el caso y, si procede, ofreceremos:

  • Reemplazo (si es posible)

  • Reembolso total o parcial

  • O solución acordada con el cliente

9. Envíos no entregados o errores de dirección

No nos hacemos responsables de retrasos o pérdidas causadas por:

  • Direcciones incorrectas o incompletas proporcionadas por el cliente

  • Falta de recogida del paquete
